1. Acceptance of Terms
By accessing or using TowTag (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform. These Terms apply to all users including tow operators, business partners, and the general public accessing public-facing features.
2. Description of Service
TowTag is a vehicle towing management platform that enables licensed tow operators to tag and dispatch vehicles, manage fleets, access a marketplace of tow-risk reports, and communicate with business partners. Public users may submit vehicle reports and access redacted marketplace data. TowTag does not directly perform towing services and is not responsible for towing decisions made by operators.
3. Operator Accounts
Operators must provide accurate business information during registration including company name, license number, and contact details. You represent that:
- You are authorized to operate as a tow company in your jurisdiction.
- All dispatched tows comply with local ordinances and state law.
- You will not use TowTag to perform unauthorized or predatory towing.
- You are responsible for all activity under your account credentials.
4. Marketplace & Reports
Vehicle reports submitted through TowTag’s public report form are user-generated content. TowTag does not verify the accuracy of submitted reports. Operators who claim and act on marketplace reports do so at their own discretion and bear full legal responsibility for any resulting tow. TowTag provides tools to document evidence but is not a party to any towing transaction.
5. Acceptable Use
You agree not to:
- Submit false or fraudulent vehicle reports.
- Use the Platform to harass, stalk, or target individuals.
- Attempt to reverse-engineer, scrape, or abuse the API.
- Circumvent subscription restrictions or account verification.
- Use TowTag data to build a competing product without written consent.
Violations may result in immediate account termination without refund.
6. Subscriptions & Billing
Paid plans are billed monthly. Subscriptions auto-renew unless cancelled before the renewal date. TowTag reserves the right to change pricing with 30 days’ notice. Refunds are not issued for partial billing periods. Downgrading your plan takes effect at the next renewal cycle.
7. Photo Evidence & Data Storage
Photos uploaded as tow evidence are stored securely and associated with the relevant vehicle report. Operators may access their uploaded photos at any time. TowTag retains photo evidence for 12 months after report closure. You retain ownership of content you upload and grant TowTag a license to store and display it within the Platform.
8. Privacy
Use of TowTag is subject to our
Privacy Policy. We collect only the data necessary to operate the service and do not sell personal information to third parties.
9. Disclaimers
TowTag is provided “as is” without warranties of any kind. We do not guarantee uninterrupted service, the accuracy of third-party data, or that the platform will meet every operator’s requirements. TowTag is not liable for towing disputes, property damage claims, or legal actions arising from towing decisions made using the Platform.
10. Limitation of Liability
To the fullest extent permitted by law, TowTag’s total liability for any claim arising from use of the Platform is limited to the amount you paid TowTag in the 3 months preceding the claim. TowTag is not liable for indirect, incidental, or consequential damages.
11. Termination
Either party may terminate the relationship at any time. TowTag reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or threaten the safety of others — without prior notice.
12. Governing Law
These Terms are governed by the laws of the State of Texas, United States. Any disputes will be resolved in the courts of Dallas County, Texas, unless otherwise agreed in writing.
13. Changes to Terms
TowTag may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or in-app notification.
